1. General Use

FleetHunt Technologies (“FHT”) provides telematics hardware, software, and related services. By using our products or services, you acknowledge that you are responsible for compliance with all applicable laws and regulations.

2. Products and Services

Our products include but are not limited to Electronic Logging Devices (ELDs), GPS tracking solutions, AI-enabled dash cameras, fleet management software, and related accessories. Service features and availability may vary depending on region, subscription plan, and hardware purchased.

3. Customer Responsibilities

• Ensure that devices are installed, maintained, and used according to manufacturer and FHT instructions.
• Maintain accurate and updated contact and billing information.
• Comply with all legal and regulatory requirements when using FHT products or services.

4. Device Ownership and Returns

Unless otherwise specified in a signed agreement, all hardware provided under a subscription plan remains the property of FHT. Customers are required to return such devices upon contract expiration, termination, or default.

5. Payment and Billing

All fees must be paid in accordance with the terms outlined in your service agreement. Late or missed payments may result in suspension of service or retrieval of leased hardware.

6. Technical Errors and Liability Disclaimer

FHT shall not be held responsible or liable for any technical errors, malfunctions, failures, delays, omissions, interruptions, defects, or inaccuracies in the operation of its hardware, software, or services. This includes but is not limited to any unintended commands, data transmissions, alerts, notifications, or actions generated due to technical error, system failure, third-party service interruption, or any other cause beyond FHT’s reasonable control.

The Customer acknowledges and agrees that FHT shall not be liable for any damages, losses, claims, or liabilities arising directly or indirectly from such occurrences, including but not limited to operational disruptions, equipment damage, personal injury, or financial loss. The Customer assumes all risks associated with reliance on data, alerts, or outputs from the system, and FHT disclaims any responsibility for actions taken or not taken in response to such information.

7. Limitation of Liability

To the fullest extent permitted by law, FHT shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, business interruption, or loss of data.

8. Indemnification

Customers agree to indemnify and hold harmless FHT, its affiliates, employees, and agents against any claims, damages, liabilities, costs, or expenses arising from use or misuse of FHT products or services.

9. Termination

FHT reserves the right to terminate or suspend access to services for breach of these Terms or non-payment. Upon termination, all outstanding obligations, including return of hardware, remain in effect.

10. Changes to Terms

FHT may update these Terms at any time. Continued use of products or services after changes are published constitutes acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Manitoba, Canada, unless otherwise specified in a separate agreement.
